Further information concerning the specific Tracking Technologies employed, their purposes, duration, and the identities of the parties placing such Tracking Technologies may be set forth in a cookie notice made available within the Services.

The Company may disclose Personal Information in connection with, or during negotiations of, any proposed or actual merger, acquisition, consolidation, reorganization, financing, sale of assets, bankruptcy, insolvency, or similar corporate transaction, in which case Personal Information may be transferred to the successor entity, subject to the continuing applicability of this Policy or a materially equivalent privacy policy.
The Company may disclose aggregated, anonymized, or de-identified data that cannot reasonably be used to identify any individual to third parties for any lawful purpose, without restriction.
The Company may disclose Personal Information with the User's consent or at the User's direction, including where the User elects to use features that enable such disclosure.
Disclosure of Personal Information to Service Providers and Third Parties

Where Personal Information is transferred from the European Economic Area, the United Kingdom, Switzerland, or other jurisdictions imposing restrictions on international data transfers, the Company shall implement appropriate safeguards as required by applicable law, which safeguards may include, without limitation, the execution of Standard Contractual Clauses approved by the European Commission or equivalent instruments, reliance upon adequacy decisions issued by competent authorities, participation in approved certification mechanisms, or the implementation of binding corporate rules.
The Company shall conduct, where appropriate, transfer impact assessments to evaluate the laws and practices of the recipient jurisdiction and shall implement such supplementary technical, organizational, and contractual measures as may be necessary to ensure a level of protection essentially equivalent to that afforded in the originating jurisdiction.
By utilizing the Services, the User acknowledges that its Personal Information may be subject to such international transfers and consents to the Processing of such Personal Information in jurisdictions other than that of the User's residence, subject to the safeguards described herein.
Copies of, or further information concerning, the safeguards implemented by the Company in respect of international data transfers may be obtained by contacting the Company at the address set forth in the final section of this Policy, subject to such reasonable redactions as may be necessary to protect commercial confidentiality.

Upon expiration of the applicable retention period, the Company shall securely delete, destroy, or anonymize the Personal Information such that it can no longer be associated with an identified or identifiable individual, except where continued retention is required by applicable law.
The Company may retain certain Personal Information in archival, back-up, or disaster recovery systems for a limited additional period following the expiration of the primary retention period, provided that such retained Personal Information shall be subject to appropriate access controls and shall not be Processed for any purpose other than legal compliance, dispute resolution, or system restoration.
Where the User exercises a right to erasure or deletion in accordance with this Policy and applicable law, the Company shall effectuate such deletion within the time period prescribed by applicable law, subject to any exceptions permitted thereunder.

The Company shall maintain and periodically test an incident response plan designed to enable the prompt detection, investigation, containment, remediation, and notification of security incidents affecting Personal Information.
In the event of a security incident resulting in the unauthorized acquisition, access, use, or disclosure of Personal Information, the Company shall provide such notifications to affected individuals, regulatory authorities, and other parties as may be required by applicable law, within the time periods prescribed thereby.
Notwithstanding the foregoing, no system of safeguards can guarantee absolute security, and the Company cannot and does not warrant or guarantee the security of Personal Information against all possible threats, and the User acknowledges and accepts the inherent risks associated with the transmission of information over the internet.

Requests to exercise the rights set forth in the preceding section may be submitted to the Company by means of the contact channels set forth in the final section of this Policy, including, without limitation, by email to [Privacy Contact Email] or by postal mail to the address of the Company set forth above.
In order to protect the security and privacy of Personal Information, the Company shall undertake reasonable measures to verify the identity of the requester prior to processing any such request, which measures may require the requester to provide additional information sufficient to permit the Company to verify, with a reasonable degree of certainty, that the requester is the individual to whom the Personal Information pertains.
The Company shall respond to verifiable requests within the time periods prescribed by applicable law, which may be extended where reasonably necessary, taking into account the complexity and number of requests received, provided that the requester shall be informed of any such extension and the reasons therefor.
Requests may be submitted by an authorized agent acting on behalf of a User, provided that such authorized agent provides proof of authorization satisfactory to the Company, and the Company reserves the right to request confirmation directly from the User.
The Company shall not discriminate against any User for exercising rights conferred by applicable privacy law, and shall not deny goods or services, charge different prices, or provide a different level or quality of goods or services on account of such exercise, except where permitted by applicable law.
The Company may decline to act upon a request where such request is manifestly unfounded, excessive, or repetitive, or where an exception provided by applicable law is applicable, in which case the Company shall inform the requester of the reasons for its decision and of the right to lodge a complaint with a competent authority.
Users dissatisfied with the Company's response to a request may appeal such response in accordance with the procedures communicated by the Company at the time of its response, and may further avail themselves of such remedies as may be provided by applicable law.

In the event the Company becomes aware that it has inadvertently collected Personal Information from a Child in contravention of this Policy or applicable law, the Company shall take prompt steps to delete such Personal Information from its systems.
Parents or legal guardians who believe that their Child has provided Personal Information to the Company without their consent are requested to contact the Company at [Privacy Contact Email], and the Company shall cooperate in good faith to investigate and address such concerns.
The Company does not condition participation in the Services upon a Child disclosing more Personal Information than is reasonably necessary, and does not sell, share, or otherwise disclose Personal Information of Children for commercial purposes.
Users under the applicable age of consent are instructed not to use the Services and not to submit any Personal Information to the Company.
Children's Privacy
The Company reserves the right, in its sole and absolute discretion, to amend, modify, supplement, or otherwise revise this Policy from time to time, in order to reflect changes in its practices, in applicable law, in technology, or in business circumstances.
Where any amendment to this Policy is material, the Company shall provide notice to Users through such means as the Company deems appropriate, which may include, without limitation, posting a prominent notice within the Services, sending a notification to the email address associated with the User's account, or displaying a banner upon the User's next visit to the Services.
The "Effective Date" and "Last Updated" dates set forth at the beginning of this Policy indicate the date on which the most recent revisions became effective, and Users are encouraged to review this Policy periodically to remain informed of its current terms.
Continued use of the Services following the effective date of any amendment shall constitute the User's acceptance of the amended Policy, except where applicable law requires the Company to obtain affirmative consent to such amendments, in which case the Company shall solicit such consent before applying the amended terms to the User.
Prior versions of this Policy may be made available upon request directed to the Company at [Privacy Contact Email], for purposes of reference and transparency.

Any dispute, claim, or controversy arising out of or relating to this Policy, including the breach, termination, enforcement, interpretation, or validity thereof, shall be submitted to the exclusive jurisdiction of the state and federal courts located in [Venue County, Governing State], and the parties hereby irrevocably consent to the personal jurisdiction and venue of such courts.
Notwithstanding the foregoing, where mandatory provisions of applicable law in the User's jurisdiction confer upon the User the right to bring proceedings before the courts of such jurisdiction, or to the benefit of consumer protection or data protection laws of such jurisdiction, nothing in this Policy shall be construed as derogating from such rights.
